Welcome to Precision Equine Stables, located at 131 S Stage Road, Medford, Oregon 97501. By accessing our website (https://pestables.com), engaging in our services, or entering our premises, you agree to be bound by these Terms of Service ("Terms") and our Privacy Policy. These Terms govern your interaction with Precision Equine Stables, its services, website, and facilities, and apply to all visitors, clients, participants, contractors, volunteers, and other individuals ("Users"). If you do not agree to these Terms or the Privacy Policy, you must not access the website or use our services.

Acceptance of Terms By accessing our website, using our services (including but not limited to horse boarding, training, exercise programs, cryotherapy, trailer storage, kids horse camp, or volunteering), or entering our premises, you automatically agree to these Terms of Service and our Privacy Policy, as well as any applicable agreements (e.g., Comprehensive Participant Agreement, Boarding Agreement, or Liability Waiver and Release Agreement). These Terms may be updated periodically, and continued use constitutes acceptance of the updated Terms. The most current version is available at https://pestables.com/terms.

Services Provided Precision Equine Stables offers the following services, subject to additional agreements where applicable:

Horse Boarding: Full-service boarding with daily turnout, feeding, and stall cleaning ($500/month, subject to change with 30 days’ notice).

Horse Training: Customized training programs for various disciplines ($50/session).

Exercise Programs: Regular workouts to maintain horse fitness ($40/session).

Equine Cryotherapy and Cold Fascia Mobilization: Cold therapy for recovery and performance ($100/monthly session, $250/one-off, with discounts for boarders).

Horse Trailer Storage: Secure parking for trailers ($35/month for horse trailers, $65/month for non-horse trailers).

Kids Horse Camp: Educational 4-day camps for ages 8–14 ($450/camper, $375 with early bird discount).

Volunteer Program: Skill-building opportunities for ages 15+ (unpaid, subject to Comprehensive Participant Agreement). All services are provided at our discretion and may require signed agreements, proof of insurance, or compliance with safety protocols. Rates and availability are subject to change.

User Responsibilities Users agree to:

Comply with all Stable rules, posted signs, safety guidelines, and staff instructions.

Provide accurate information (e.g., contact details, horse health records, emergency contacts) when requested.

Maintain appropriate insurance (e.g., liability for boarders, general liability for contractors) and provide proof upon request.

Ensure minors are supervised and have parental consent for activities, including signed agreements.

Refrain from prohibited behaviors, including smoking, bringing unauthorized dogs, making loud noises, or using alcohol/drugs on premises.

Wear appropriate attire and personal protective equipment (e.g., closed-toe shoes, helmets for riding). Failure to comply may result in immediate termination of services, removal from premises, or legal action.

Assumption of Risk Users acknowledge that equestrian activities and presence on our premises involve inherent risks, including but not limited to:

Injury from horse behavior (e.g., kicks, bites, being thrown).

Slips, trips, or falls on uneven or slippery surfaces.

Exposure to allergens (e.g., hay, dust, animal dander) or environmental hazards.

Equipment failure or misuse.

Weather-related risks (e.g., heat, cold, lightning). By accessing our services or premises, Users voluntarily assume all such risks, whether known or unknown, and acknowledge that equine activities carry a high degree of danger.

Release of Liability Under Oregon Law (ORS 30.687-30.697), equine activity sponsors are not liable for injuries or death arising from equine activities. Users waive, release, and discharge Precision Equine Stables, its owners, staff, volunteers, contractors, affiliates, and agents ("the Stable") from all claims, demands, damages, or liabilities arising from their presence on the premises or participation in services, including those caused by the Stable’s negligence, except in cases of gross negligence or intentional misconduct.

Indemnification

Users agree to indemnify, defend, and hold harmless Precision Equine Stables, its owners, employees, agents, and affiliates from any claims, demands, damages, losses, liabilities, or expenses (including reasonable attorney’s fees and court costs) arising from:

User’s actions, omissions, or behavior, including those of their horse, guests, or minors under their supervision.

Failure to comply with these Terms, Stable rules, or signed agreements.

Injury, death, or property damage caused by User or their horse, whether on or off Stable premises. This indemnification does not apply to claims resulting from the Stable’s gross negligence or willful misconduct.

Insurance Requirements

Boarders must maintain liability and mortality insurance for their horse and provide proof upon request.

Contractors must maintain comprehensive general liability insurance ($1,000,000 per occurrence, $2,000,000 aggregate) and, if applicable, workers’ compensation insurance, naming the Stable as an additional insured.

Volunteers and other Participants acknowledge that the Stable provides no insurance coverage for their activities and are encouraged to maintain personal liability and health insurance. The Stable maintains general liability insurance for its operations, which may provide limited protection subject to policy terms. Users are responsible for any lapses or changes in their coverage and must notify the Stable immediately.

Payment Terms

Boarding fees ($500/month) and additional services (e.g., exercise, training) are due by the 1st of each month. A $35 late fee applies after 10 days.

Users authorize ACH payments for recurring fees, providing bank account details as outlined in the Boarding Agreement.

Non-payment beyond 30 days may result in lien rights, withholding of the horse, or legal remedies, including sale of the horse to recover fees, per Oregon law.

Users are responsible for collection fees, attorney fees, and court costs arising from non-payment.

Termination

Users may terminate services with 30 days’ written notice, subject to agreement terms (e.g., Boarding Agreement requires assistance in finding a replacement boarder).

The Stable may terminate services immediately for breaches of these Terms, non-payment, unsafe behavior, or disruption to operations.

No refunds are issued for early termination, temporary horse removal, or pro-rated services.

Safety and Conduct Users must:

Complete mandatory safety briefings or training (e.g., horse handling, emergency procedures).

Report accidents, injuries, property damage, or animal welfare concerns immediately.

Use Stable-approved equipment and methods when interacting with horses.

Maintain professional conduct, avoiding harassment, discrimination, or disruptive behavior.

Ensure work/activity areas are safe, organized, and free of hazards.

Violations may result in immediate removal from premises and termination of services.

Photo, Video, and Media Consent Users grant the Stable permission to photograph, film, or record them or their horse(s) for promotional, marketing, or educational purposes without compensation. Users may opt out by submitting a written request to [email protected] before activities begin.

Dispute Resolution Disputes arising from these Terms or related agreements shall first be addressed through mediation. If unresolved, disputes will be settled via binding arbitration under the American Arbitration Association’s rules in Jackson County, Oregon. The prevailing party may recover reasonable attorney’s fees and costs.

Non-Defamation Users agree to resolve grievances amicably with Stable management and refrain from posting harmful or defamatory reviews on social media or other platforms. In case of a breach, this agreement may be used to request removal of such reviews.

Confidentiality Users shall maintain the confidentiality of proprietary Stable information, including business practices, client data, and animal care protocols, and shall not disclose such information to third parties without written consent.

Force Majeure The Stable is not liable for failure to perform obligations due to events beyond its control (e.g., natural disasters, pandemics, government regulations). Boarding fees will not be refunded, but the Stable will make reasonable efforts to ensure horse safety.

Governing Law These Terms are governed by and construed under the laws of the State of Oregon, without regard to conflict of law principles. Any legal actions not subject to arbitration shall be filed in Jackson County, Oregon.

Severability If any provision of these Terms is found invalid or unenforceable, the remaining provisions shall remain in full force and effect.

Entire Agreement These Terms, along with any applicable signed agreements (e.g., Comprehensive Participant Agreement, Boarding Agreement, Liability Waiver), constitute the entire understanding between the User and the Stable, superseding all prior agreements. Amendments must be in writing and signed by both parties.
